Collection of Personal Information
We collect personal information from and about consumers who use our Services, including when consumers create an account, make a donation, volunteer, interact with our social media accounts, or otherwise interact with us. Depending on the context in which you interact with us, this may include contact details, demographics, professional information, payment information, health-related information, unique online identifiers and browsing activity, or inferences we draw about you.
How We Use Personal Information
We use personal information to provide, manage, analyze, and improve our Services; communicate with consumers; conduct fundraising and promotional activities; analyze and understand consumers’ needs, preferences, and interests; and for legal purposes, including to comply with our obligations, enforce our rights and policies, and prevent against security incidents and fraud.

March of Dimes (“we,” “us,” “our”) recognizes the importance of protecting your privacy. This Privacy Policy explains the types of information we collect about you online or offline, when you visit our websites, mobile applications, and blogs, or otherwise interact with us (collectively, the “Services”), the ways we use this information, and the choices you can make regarding our use of your personal information.

II. Purposes for Processing Personal Information

We may also aggregate and/or anonymize personal information and analyze those data for statistical or any other purposes permitted by law. When we do so, we take reasonable measures to ensure that the information cannot be associated with a consumer or household, and we maintain and use the information in deidentified form. We will not attempt to reidentify the information, except that we may attempt to reidentify the information solely for the purpose of determining whether our deidentification processes satisfy applicable legal requirements. After it has been deidentified, the information is no longer personal information and is not subject to this Privacy Policy.
III. Sources of Personal Information
We collect personal information directly from consumers when they interact with us. We also collect personal information from vendors and third parties, when they provide information to us. For example, we may receive names and addresses of potential donors from other organizations, and we may collect personal information from vendors and third parties to supplement or verify the accuracy of that contact information. We also collect personal information from vendors and third-party providers of cookies and other tracking technologies used on our Services.
IV. Disclosure of Personal Information
We disclose the categories of personal information listed in Section I as detailed below:

To our vendors. We disclose personal information to our vendors who process personal information on our behalf, including vendors who provide website hosting, information technology and infrastructure, data analytics and modeling, email delivery, order fulfillment, auditing, payment processing, marketing and analytics services, and other services to us. We impose contractual limitations on our vendors’ use of personal information they collect in conjunction with providing services to us.

To third parties for marketing purposes. We disclose personal information to third parties, such as third-party marketing and analytics providers, and other organizations for marketing purposes, including to support our fundraising efforts and the fundraising efforts of third parties.

To third parties to facilitate our programming and fundraising. We also disclose personal information to other third parties to facilitate our programming and fundraising. For example, we may disclose personal information in the following scenarios, and for similar purposes and programs:
- If you join a team on one of our fundraising websites, your name and the total amount you have raised will be available to the team captain. If the team page is made public, your name and other information about your participation may be publicly-accessible.
- If you submit personal information to us via our “Submit your story” page, your story may be featured on our national digital channels to spread awareness and inspire other families. Similarly, if you participate in any contests/sweepstakes we offer, post or interact with us publicly on social media or on any of our Services, such information may be publicly available.
- If you make a donation by credit card or other electronic means (e.g., Venmo, Paypal), your personal information will be collected by the third-party payment processor/platform to facilitate your donation.
- If you are a donor or prospective donor, we may disclose your personal information, such as your name, address, and giving history, to third parties, such as marketing cooperatives, event sponsors, and other nonprofit and for-profit companies, to help improve our fundraising and marketing efforts and those of other organizations.
- If you participate in programs we offer via your employer/organization, such as our Becoming a Mom online educational program, we may disclose your participation and progress to your employer/organization.
- To other third parties, at your direction or with your consent. We may disclose your personal information to any other third parties at your direction or with your consent.
We may also disclose personal information in the following contexts:

Pursuant to a change of control. We may disclose personal information to a successor entity or purchaser upon a merger, consolidation, or other reorganization in which we participate, or a sale of all or a portion of our assets. In this situation, we will seek assurances that the successor entity or purchaser will process personal information collected by us in accordance with this Privacy Policy.

For legal purposes. We may disclose personal information to protect our rights, defend or pursue a legal claim, investigate or prosecute illegal activities, comply with a subpoena, court order, governmental inquiry, legal process, or other legal obligation, or to protect the rights, property, or safety of us, you, or any other consumers.
We may also disclose aggregated and/or anonymized data to any other entities to the extent permitted by law.
V. Children’s Privacy
Our Services are not intended for children under age 13 and are not designed to attract the attention of anyone under age 13. Further, for compliance with the Children’s Online Privacy Protection Act of 1998, we do not knowingly collect personal information from children under age 13. If you are a parent or guardian and believe we have collected personal information from your child in error, please contact us immediately using our Contact Us page so that we can make reasonable efforts to promptly remove such personal information from our systems.
We may, however, collect personal information about your child that you submit to us, such as information you provide via our “Submit your story” page, or your child’s name, e-mail address, and/or postal address in order to register them in March of Dimes activities, such as our annual March for Babies event. We process such personal information in accordance with this Privacy Policy.
VI. Third-Party Links on Our Services
Our Services may contain links to websites and apps owned by other entities. If you decide to use these links, you will leave our Services. We are not responsible for the privacy practices or the content provided by such third parties, and we make no representations or endorsements about them. If you decide to leave our Services to access third party links, it will be at your own risk, and you should be aware that this Privacy Policy will no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any other third party when you navigate away from our Services.
VII. Security & Retention
We implement technical and organizational measures to protect consumers’ personal information, including encryption, firewalls, and password protection. Our servers are housed in an off-site, secured facility, and we require our employees and vendors to protect the privacy of personal information we collect and adhere to our Privacy Policy.
We retain personal information for the period reasonably necessary to provide our services to you, support our business operational purposes listed in Section II, and ensure compliance with applicable law.
VIII. Additional Disclosures for Certain U.S. Residents
This section provides disclosures applicable to residents of U.S. states with comprehensive privacy laws that apply to March of Dimes.

Data Subject Rights. Residents of some U.S. states have certain rights with respect to the processing of their personal information. Depending on your state of residence, these rights may include rights to access, correct, and delete your personal information, or to opt out of certain types of processing of personal information. - Colorado Residents. Colorado residents have rights to access, correct, and delete their personal information, to obtain their personal information in a portable format, to opt out of sales of their personal information, processing of their personal information for purposes of targeted advertising, and profiling of their personal information in furtherance of decisions that produce legal or similarly significant effects, and to revoke their consent to certain types of processing activities.
- Minnesota Residents. Minnesota residents have rights to access, correct, and delete their personal information, to confirm whether or not their personal information is being processed by the organization, to obtain their personal information in a portable format, to opt out of sales of their personal information, processing of their personal information for purposes of targeted advertising, and profiling of their personal information in furtherance of decisions that produce legal or similarly significant effects, to question the results of and obtain information about profiling decisions about them, to obtain a list of the specific third parties to which the organization has disclosed their personal information, and to revoke their consent to certain types of processing activities.

Exercising Data Subject Rights & Authorized Agents. If you wish to exercise your data subject rights, including the right to delete your Personal Data or any other applicable rights, please submit a request through our Contact Us form. Residents of some states, including Colorado, may also authorize an agent to make data subject requests on your behalf. In such instances, authorized agents may use the same method as you to submit requests on your behalf. To verify your identity and protect your personal information, we may ask the requestor to provide information that will enable us to verify your identity in order to comply with your data subject request, such as asking your agent to provide proof of signed permission from you, or ask you to confirm with us directly that you provided the agent with permission to submit the request. In some instances, we may decline to honor your request if an exception applies under applicable law. We will respond to your request consistent with applicable law.

If you submit an appeal, please enclose or otherwise specifically reference your initial request so that we may appropriately assess and respond to your appeal. Sales & Processing for Purposes of Targeted Advertising. We sell personal information and process personal information for targeted advertising purposes, as those terms are defined by state comprehensive privacy laws. For example, we disclose personal information to third parties for marketing and fundraising purposes. This includes information we collect via cookies and other tracking technologies, such as IP address and browsing data. It also includes names, contact, and related information, such as information about our donors, to improve our fundraising efforts and the fundraising efforts of other organizations. Opt-Out Preference Signals. Some web browsers or devices offer settings where you may pre-set a signal to websites that you do not want to have your online activity and behavior sold or processed for targeted advertising purposes. We recognize opt-out preference signals to the extent we are required to do so for compliance with applicable law. Please note, however, that our websites are not currently configured to recognize the “Do Not Track” signal.

Profiling. We do not process personal information for profiling in furtherance of legal or similarly significant effects.
Please note that some state privacy laws, including the California Consumer Privacy Act (“CCPA”), do not regulate processing of personal information by 501(c)(3) non-profit organizations like March of Dimes. The disclosures in this section do not apply to consumers who reside in states with state privacy laws that do not apply to March of Dimes.

IX. Other Disclosures

Text Messaging. We may offer consumers the opportunity to opt in to receive text messages from March of Dimes, relating to March of Dimes programming and fundraising. If you opt in to receive such messages, we may send you text messages for such purposes, including via automated systems or prerecorded messages. You can opt out at any time by replying “STOP,” “QUIT,” “END,” “CANCEL,” “UNSUBSCRIBE,” or “STOP ALL” to any mobile message from us. Your opt-in choice and consent to receive text messages from March of Dimes will not be shared with third parties.

California Residents Under 18. If you are under the age of 18 and a registered user of our website, you may ask us to remove content or data that you have posted to the website by sending a request using our Contact Us page. Please note that your request does not ensure complete or comprehensive removal of the content or data as, for example, some of your content or data may have been reposted by another user.

Direct Marketing Disclosure for California Residents. Mobile Applications
March of Dimes grants you a non-exclusive, non-transferable, revocable license to use the software (the “Licensed Application”) to access the March of Dimes mobile applications for your personal use on any mobile device that you own or control. You agree that you will not:

- Remove, circumvent, disable or otherwise interfere with the security features of the Licensed Application which prevent copying of the Licensed Application.
- Delete the copyright and other proprietary rights notices and symbols on the Licensed Application.
- Hack or take any steps to interfere with any security features in the app in order to gain information in connection with the users of the app or to otherwise breach the privacy of any app user.
From time to time, March of Dimes may electronically upgrade versions of the Licensed Application and you consent to any automatic upgrading on your mobile device and agree that these Terms of Use will apply to all such upgrades.
If you purchase any Licensed Application through the iTunes or Google Play or another App store (and “App store”), you acknowledge and agree that:
1. These Terms of Use are between you and March of Dimes, not an App store, and March of Dimes is solely responsible for:
- The Licensed Application and its content.
- All maintenance and support of the Licensed Application. No App store has an obligation whatsoever to furnish any such services.
- The investigation, defense, settlement and discharge of any claim made by a third party that the Licensed Application or an end-user’s possession and use of the Licensed Application infringes that third party’s intellectual property rights.
2. In the event of any failure of the Licensed Application to conform to any applicable warranty, the end-user may notify the pertinent App store and the App store may refund the purchase price for the Licensed Application to that end-user. To the maximum extent permitted by applicable law, the App store will have no other warranty obligation whatsoever with respect to the Licensed Application and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be governed by these Terms of Use and any law applicable to March of Dimes as owner and distributor of the software.
3. March of Dimes, not the App store, is responsible for addressing any claims of the end-user or any third party relating to the Licensed Application or the end-users possession and/or use of the Licensed Application, including, but not limited to, any (i) product liability claims; (ii) claims that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
4. Your use of the Licensed Application must comply with the App store's Terms of Service.
5. Each relevant App store is an intended third-party beneficiary of these Terms of Use and, upon your acceptance of the Terms of Use, an App store will have the right (and will be deemed to have accepted the right) to enforce the Terms of Use against any end-user as a third party beneficiary thereof.
6. You will comply with any applicable third-party terms of agreement – such as the wireless data service agreement -- when using the Licensed Application.
You represent and warrant that you are not (i) located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) listed on any U.S. Government list of prohibited or restricted parties.

E-Learning Terms and Conditions.
The following additional terms are applicable to the following March of Dimes Programs: (1) Health Equity Education (E-Learning); and (2) Professional Education (E-Learning). You may receive access to MOD E-Learning through your sponsoring employer / organization.
Access to Program. For the duration of the Subscription Term for the relevant Program Services, MOD has granted your sponsoring employer / organization with a limited, non-transferable, non-assignable, non-sublicensable, non-exclusive license to access the Program for a certain number of seats. In connection with using the Program Services, you agree that will not:
- reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, object code, or underlying structure, ideas, or algorithms of the Program Services;
- modify, translate, or create derivative works based on the Program;
- use the Program for timesharing or for any purpose other than your own use for the benefit of your sponsoring employer / organization;
- use the Program other than in accordance with these terms, the terms and conditions between your sponsoring employer / organization and March of Dimes, and in compliance with all applicable laws and regulations; and/or
- grant any sublicenses to the Program.
You acknowledge that certain aspects of Programs Services may interface with or be enabled by third-party applications or services purchased by March of Dimes from third parties, such as third party learning management systems. MOD MAKES NO WARRANTY WITH RESPECT TO ANY THIRD-PARTY APPLICATIONS, AND MOD SHALL HAVE NO LIABILITY SHOULD PROGRAM SERVICES OR CLIENT CONTENT BECOME UNAVAILABLE DUE TO ERRORS OR UNAVAILABILITY OF SUCH THIRD-PARTY APPLICATIONS OR SERVICES.
